As noted in the market release of 14 September 2001 agreement has been reached between the company and the Tasmanian STate Government in respect of the Tasmanian Forests Agreement. The company is continuing to assess the matters arising as a result of the agreement and other developments in respect of the company restructure and Bell Bay pulp mill project.
The company expects to finalise a market update for release prior to market opening on 19 September 2011 with re-quotation of the company’s securities to occur at that time.

• Meanwhile, Malcolm of Hobart has requested FOI on legal advice received by the EPA in regard to ‘substantial commencement’:
I am responding to your request for information under the Right to Information Act 2009 (the Act) which was received by this Department on 29 August 2011. You are seeking details of legal advice received by the Department (EPA) with regard to “substantial commencement” of the Gunns pulp mill project and any related communications between the EPA and Gunns.
I wish to inform you that there has not been any such legal advice obtained by the EPA. For your future reference, under the provisions of the Act, legal advice obtained by the Department from the Solicitor General or Crown Solicitor is automatically exempt from disclosure pursuant to section 31 (Legal professional privilege).
I have attached the only information held by the EPA with regard to communications with Gunns on the subject of “substantial commencement” of the project. This is being released to you as Active Disclosure under the terms of the Act. Please note that the sentence that is blocked out in the EPA Director’s email is information which is outside the scope of your request.
Please contact me if you have any queries in relation to this decision.
